I had an accident at work and I am the employer, insurer says policy wont cover me?

one of my employees ran over my foot on the premises and broke my leg, I have employers and public liability insurance, can I make a claim? I thought public liability covered third parties, company is sole trader, not limited. Please can someone advise? thanks

I’d see a solicitor. A way out may be to sue your employee
who in acting in his employment possibly caused the accident. The employee will be covered by the insurance, but see the solicitor iirst and get him to outline the problems that such a move will cause between you and your employee, who should in any event be covered 100% by the inssurer. However, I can not stress the importance of a good solicitor and you taking the insurance policy when you se him. The matter will not be clear cut. A mention of the “Himalaya” case which was a shipping/insurance one may well help to concentrate his mind . Don’t worry about it being shipping the principal behind it is I think the same.
